Terms of Service

These terms apply to all users of MaskNote (the app/service).

These Terms of Service ("Terms") set forth the conditions for using the MaskNote application ("App" or "Service") provided by mtcm-lab ("we", "us", or "our"). By using the Service, you agree to these Terms.

Article 1 (Scope)
1. These Terms apply to all relationships between you and us regarding your use of the Service.
2. Any separate guidelines, notices, or help materials related to the Service (collectively, "Additional Rules") form part of these Terms.
3. If these Terms conflict with any Additional Rules, the Additional Rules take precedence.

Article 2 (Definitions)
In these Terms, the following definitions apply:
1. "User": any person who uses the Service.
2. "User Content": learning data created, saved, or exported by a User in the Service (e.g., question text, masked parts, categories, images, CSV files).
3. "External Services": third-party services related to Service operation, including Google Play, Apple App Store, and RevenueCat.

Article 3 (Use of the Service)
1. You use the Service at your own responsibility.
2. If you are a minor, you must obtain consent from a parent or legal guardian before using the Service.
3. You are responsible for all devices, network access, and communication fees required to use the Service.

Article 4 (Service Content)
1. The Service provides functions to support creating, saving, and reviewing fill-in-the-blank study materials.
2. The Service does not guarantee learning outcomes, exam results, or grade improvements.
3. Service features may change for improvements or additions.

Article 5 (Payments and Purchases)
1. The Service may include in-app purchases (including one-time purchases and subscriptions; details are shown in each app store listing).
2. Purchases, payments, cancellations, refunds, and related handling are governed by the terms and procedures of your platform provider (Google Play, Apple, etc.) and External Services.
3. Except where required by law, we are not obligated to provide refunds, including accidental purchases by Users (store policies take precedence).
4. If fraudulent use is suspected, we may restrict access to the Service as necessary.

Article 6 (Handling of User Content)
1. You are responsible for creating, using, storing, and backing up your User Content.
2. You represent and warrant that your User Content does not infringe any third-party rights (including copyright, trademark, and privacy rights).
3. We are not liable for loss or damage of User Content, including inability to restore data due to device failure or device change.
4. If we provide content sharing or publishing features in the future, you grant us a non-exclusive, royalty-free license to use User Content to the extent necessary for those features (including reproduction, distribution, display, and storage). Details may be defined separately.

Article 7 (Intellectual Property)
1. Intellectual property rights related to the Service (excluding User Content), including program code, UI, logos, text, and images, belong to us or legitimate rights holders.
2. You may use the Service only within the scope permitted by these Terms.

Article 8 (Prohibited Conduct)
You must not:
1. Violate laws or public order and morals.
2. Infringe our rights or third-party rights (including copyrights, trademarks, reputation, and privacy).
3. Interfere with Service operation (including excessive load, unauthorized access, analysis/tampering/reverse engineering).
4. Engage in fraudulent billing or falsification of purchase status.
5. Impersonate another person.
6. Provide benefits to antisocial forces or otherwise engage with them.
7. Engage in other conduct we deem inappropriate.

Article 9 (Suspension and Refusal)
We may suspend or refuse all or part of the Service for a User without prior notice if we determine that:
1. The User violates these Terms.
2. Payment default or fraudulent payment is detected.
3. Continued use is otherwise deemed inappropriate by us.

Article 10 (Disclaimer and Limitation of Liability)
1. We make no express or implied warranties regarding completeness, accuracy, usefulness, fitness for a particular purpose, or uninterrupted availability of the Service.
2. We are not liable for any damages arising from use or inability to use the Service (including data loss, lost learning opportunities, or lost profits), except in cases of willful misconduct or gross negligence by us.
3. Even where we are liable, our total liability is limited to the greater of: (i) the total amount paid by the User to us in the most recent one month, or (ii) JPY 1,000, unless prohibited by applicable law.

Article 11 (Change, Interruption, and Termination)
1. We may interrupt all or part of the Service without prior notice due to maintenance, failures, External Service specification changes, natural disasters, or similar events.
2. We may terminate the Service by providing notice through reasonable means.

Article 12 (Amendments to Terms)
1. We may amend these Terms as necessary.
2. Amended Terms become effective when announced by the method separately specified by us.
3. Continued use of the Service after amendments constitutes acceptance of the amended Terms.

Article 13 (Personal Information and Data)
1. We handle information related to Users in accordance with our separately published Privacy Policy.
2. The Service may process purchase history and anonymous identifiers for functions such as purchase status verification.
3. Even when OCR or similar features are provided, the Service is designed not to send user-selected images to external servers except where explicitly stated otherwise.

Article 14 (Notices and Contact)
1. Notices from us may be provided through in-app display, posting on our website, or other methods we deem appropriate.
2. Inquiries should be sent to the contact point we specify separately (e.g., email).

Article 15 (Governing Law and Jurisdiction)
1. These Terms are governed by and interpreted in accordance with the laws of Japan.
2. Any dispute between you and us related to the Service is subject to the exclusive jurisdiction of the courts in Japan that have jurisdiction over our principal place of business as the court of first instance.

Supplementary Provision
These Terms take effect on January 6, 2026.
